01 About our privacy policy
Fresh Parts cares a lot about your privacy. We therefore only process data that we need for (improving) our services and handle the information we have collected about you and your use of our services with care. We never make your data available to third parties for commercial purposes. This privacy policy applies to the use of the website and the services provided by Fresh Parts. The starting date for the validity of these conditions is 16/05/2023, with the publication of a new version the validity of all previous versions expires. This privacy policy describes what information about you is collected by us, what this information is used for and with whom and under what conditions this information may be shared with third parties. We also explain to you how we store your data and how we protect your data against misuse and what rights you have with regard to the personal data you provide to us. If you have any questions about our privacy policy, please contact our privacy contact person, whose contact details can be found at the end of our privacy policy.
02 About data processing
Below you can read how we process your data, where we store it, which security techniques we use and for whom the data is visible.
Online store software — Shopify
Our online store was developed with software from Shopify. Personal data that you make available to us for the benefit of our services will be shared with this party. Shopify has access to your data to provide us with (technical) support, they will never use your data for any other purpose. Shopify is obliged to take appropriate security measures based on the agreement we have concluded with them. These security measures consist of the application of SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information regarding your use of the software, no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own group to further improve services. Shopify takes into account the applicable legal retention periods for (personal) data. The EU/US Privacy Shield applies, your data may be processed in the United States.
Web hosting — MyDomain
We purchase web hosting and email services from MijnDomein. MijnDomein processes personal data on our behalf and does not use your data for its own purposes. This party can collect metadata about the use of the services. This is not personal data. MijnDomein has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. MijnDomein is obliged to maintain confidentiality under the agreement.
Email and mailing lists — Shopify
Our website uses Shopify, a third party that handles e-mail traffic from our website and the sending of any newsletters. All confirmation emails you receive from our website and web forms are sent via Shopify's servers. Shopify will never use your name and email address for its own purposes. At the bottom of every email sent automatically via our website you will see the 'unsubscribe' link. Your personal data is stored securely by Shopify. Shopify uses cookies and other internet technologies that provide insight into whether emails are opened and read.
03 Payment processors
Pay.nl
We use the payment service provider Pay.nl to process (part of) the payments in our online store. Pay.nl processes your name, address and residence details and your payment details such as your bank account or credit card number. Pay.nl has taken appropriate technical and organizational measures to protect your personal data. Pay.nl reserves the right to use your data to further improve its services and to share (anonymized) data with third parties in this context. Pay.nl does not store your data for longer than permitted by the legal terms.
Mollie
We use the Mollie platform to process (part of) the payments in our online store. Mollie processes your name, address and residence details and your payment details such as your bank account or credit card number. Mollie has taken appropriate technical and organizational measures to protect your personal data. Mollie reserves the right to use your data to further improve the services and in this context to share (anonymized) data with third parties. Mollie does not store your data for longer than is permitted by the legal periods.
iDEAL, Bancontact and PayPal
We use the iDEAL, Bancontact and PayPal platform to process (part of) the payments in our online store. These parties process your name, address and residence details and your payment details such as your bank account or credit card number. They have taken appropriate technical and organizational measures to protect your personal data. iDEAL, Bancontact and PayPal do not store your data for longer than permitted by the legal terms.
04 Reviews — WebwinkelKeur
We collect reviews via the WebwinkelKeur platform. If you leave a review via WebwinkelKeur, you are required to provide a name and email address. WebwinkelKeur shares this information with us so that we can link the review to your order. WebwinkelKeur also publishes your name on its own website. WebwinkelKeur has taken appropriate technical and organizational measures to protect your personal data.
05 Shipping and logistics
If you place an order with us, it is our job to have your package delivered to you. We use the services of PostNL, DHL and DPD to carry out deliveries. It is therefore necessary that we share your name, address and residence details with these parties. They only use this information for the purpose of executing the agreement. If they engage subcontractors, they will also make your data available to these parties.
06 Purpose of data processing
We use your data exclusively for the purpose of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. Your data will not be shared with third parties, other than to comply with accounting and other administrative obligations.
Automatically collected data
Data collected automatically by our website is processed with the aim of further improving our services. This data (for example your IP address, web browser and operating system) is not personal data.
07 Retention periods
We keep your data as long as you are our client. This means that we keep your customer profile until you indicate that you no longer wish to use our services. This also means that we do not store your data for longer than two years from the last moment of contact or transaction, unless there is a legal justification for doing so. Based on applicable administrative obligations, we must keep invoices with your (personal) data, so we will keep this data for as long as the applicable period runs.
08 Your rights
Under applicable Dutch and European legislation, you as a data subject have certain rights with regard to the personal data processed by or on behalf of us. You have the right to file a complaint with the Dutch Data Protection Authority at any time if you suspect that we are using your personal data incorrectly.
Right of inspection
You always have the right to inspect the data that we process or have processed that relates to your person or can be traced back to you. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days.
Right of rectification
You always have the right to have the data that we process or have processed that relates to your person or can be traced back to you amended. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days.
Right to restriction of processing
You always have the right to limit the data that we process that relates to your person or that can be traced back to you. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days.
Right to portability
You always have the right to have the data that we process or have processed that relates to your person or can be traced back to you, processed by another party. You can make a request to this effect to our contact person for privacy matters. You will then receive a response to your request within 30 days.
Right to object
Where appropriate, you have the right to object to the processing of your personal data by or on behalf of Fresh Parts. If you object, we will immediately stop data processing pending handling of your objection. You also have the right not to be subject to automated individual decision-making or profiling.

In the event that third-party software solutions use cookies, this is stated in this privacy statement.
10 Changes to the privacy policy
We reserve the right to change our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy has consequences for the way in which we process already collected data relating to you, we will inform you by e-mail.

FreshTrack hecht veel waarde aan de privacy van haar gebruikers. In dit privacybeleid leggen wij uit welke gegevens de FreshTrack-app gebruikt, waarom deze gegevens nodig zijn en welke keuzes en rechten gebruikers hebben.
FreshTrack is een navigatie-, verkeersinformatie- en GPS-app waarmee gebruikers onder andere hun locatie, actuele snelheid, rijrichting en rit kunnen bekijken en navigatiefuncties kunnen gebruiken.
1. Wie is verantwoordelijk voor de verwerking van gegevens?

Deze organisatie is verantwoordelijk voor de verwerking van persoonsgegevens binnen FreshTrack.
2. Welke gegevens gebruikt FreshTrack?
FreshTrack verwerkt alleen gegevens die nodig zijn voor het functioneren van de app.
Locatiegegevens
FreshTrack kan toegang vragen tot de locatie van het apparaat, waaronder de nauwkeurige GPS-locatie.
Deze locatiegegevens worden gebruikt voor functies zoals:
- het bepalen en tonen van de huidige locatie
- navigatie en routebegeleiding
- het berekenen en tonen van de actuele snelheid
- het bepalen van de rijrichting
- het registreren en weergeven van een rit of route
- het tonen van relevante verkeersinformatie en meldingen op of rondom de route
FreshTrack gebruikt locatiegegevens niet voor advertenties, marketing of het opbouwen van advertentieprofielen.
Locatiegegevens worden niet verkocht.
3. Toestemming voor locatie
FreshTrack gebruikt de locatie van het apparaat alleen nadat de gebruiker hiervoor toestemming heeft gegeven via de instellingen van het apparaat.
De gebruiker kan deze toestemming op ieder moment intrekken via de Android-instellingen.
Wanneer locatietoegang wordt uitgeschakeld, blijven onderdelen van FreshTrack waarvoor geen locatie nodig is mogelijk beschikbaar. Functies zoals navigatie, GPS-snelheidsmeting, positie op de kaart en ritregistratie kunnen zonder locatietoegang niet of niet correct functioneren.
FreshTrack vraagt niet om meer toegang tot locatiegegevens dan noodzakelijk is voor de aangeboden functionaliteit.
4. Locatie op de achtergrond
Wanneer een gebruiker een navigatie- of ritregistratiefunctie activeert, kan het noodzakelijk zijn dat FreshTrack de locatie blijft gebruiken wanneer de app niet actief op het scherm staat, bijvoorbeeld wanneer:
- het scherm van het apparaat wordt uitgeschakeld
- FreshTrack naar de achtergrond wordt verplaatst
- een andere app tijdelijk wordt geopend
Dit is nodig om een actieve rit, navigatie, snelheid of route correct te kunnen blijven registreren en weergeven.
FreshTrack gebruikt locatie op de achtergrond alleen wanneer dit noodzakelijk is voor een door de gebruiker geactiveerde functie en wanneer hiervoor de vereiste toestemming is gegeven.
De gebruiker kan locatietoegang op de achtergrond altijd uitschakelen via de instellingen van het apparaat.
5. Snelheid en ritgegevens
Op basis van GPS- en locatiegegevens kan FreshTrack informatie berekenen zoals:
- actuele snelheid
- afgelegde afstand
- rijrichting
- route
- duur van een rit
- begin- en eindpunt van een rit
Deze informatie wordt uitsluitend gebruikt om de betreffende functies van FreshTrack aan de gebruiker aan te bieden.
GPS-metingen kunnen afhankelijk van het apparaat, satellietbereik, weersomstandigheden en omgeving tijdelijk afwijken. De door FreshTrack weergegeven snelheid is daarom een GPS-berekening en vormt geen vervanging voor de officiële snelheidsmeter van het voertuig.
6. Opslag van locatie- en ritgegevens
FreshTrack bewaart persoonsgegevens niet langer dan noodzakelijk is voor het doel waarvoor deze worden gebruikt.
Locatiegegevens die uitsluitend nodig zijn voor het bepalen van de actuele positie, snelheid of navigatie worden in beginsel alleen verwerkt zolang dit nodig is voor die functie.
Wanneer FreshTrack een mogelijkheid biedt om ritten of routegeschiedenis op te slaan, kunnen gegevens zoals route, afstand, snelheid en tijd worden bewaard zodat de gebruiker deze later kan bekijken.
Wanneer gebruikers opgeslagen ritten kunnen verwijderen, worden de betreffende gegevens verwijderd overeenkomstig de werking van die functie.
FreshTrack gebruikt locatiegegevens niet om zonder functionele noodzaak een permanent locatieprofiel van gebruikers op te bouwen.
7. Delen van gegevens met derden
FreshTrack verkoopt geen locatiegegevens of andere persoonsgegevens aan derden.
Voor bepaalde technische functies kan FreshTrack gebruikmaken van externe dienstverleners, bijvoorbeeld voor kaarten, routeberekeningen, hosting of andere infrastructuur die noodzakelijk is om de app te laten functioneren.
FreshTrack deelt locatiegegevens niet met adverteerders voor gepersonaliseerde advertenties.
8. Technische gegevens
Voor de werking en beveiliging van de app kunnen beperkte technische gegevens worden verwerkt wanneer dit noodzakelijk is, bijvoorbeeld informatie over fouten of crashes van de app.
Wanneer hiervoor externe software of SDK's wordt gebruikt, wordt dit verwerkt overeenkomstig dit privacybeleid en moet deze verwerking ook worden opgenomen in de privacy- en gegevensveiligheidsinformatie van FreshTrack.
FreshTrack probeert de hoeveelheid verwerkte gegevens zo beperkt mogelijk te houden.
9. Beveiliging
FreshTrack neemt passende technische en organisatorische maatregelen om persoonsgegevens te beschermen tegen:
- verlies
- onbevoegde toegang
- ongewenste openbaarmaking
- wijziging
- misbruik
Wanneer persoonsgegevens tussen het apparaat en externe servers worden verzonden, wordt waar mogelijk gebruikgemaakt van beveiligde en versleutelde verbindingen.
10. Geen verkoop of gebruik voor advertenties
FreshTrack verkoopt geen persoonsgegevens.
Locatiegegevens worden niet gebruikt voor:
- gepersonaliseerde advertenties
- advertentieprofielen
- het volgen van gebruikers voor commerciële marketingdoeleinden
- verkoop aan datahandelaren
Locatiegegevens worden gebruikt om de functies van FreshTrack mogelijk te maken.
11. Accounts en verwijderen van gegevens
Wanneer gegevens uitsluitend lokaal op het apparaat worden opgeslagen, kan de gebruiker deze gegevens verwijderen via de daarvoor beschikbare functies in de app, door appgegevens te wissen of door de app te verwijderen.
Gebruikers kunnen verzoeken hun account en de daaraan gekoppelde persoonsgegevens te verwijderen. FreshTrack verwijdert de bij het account behorende persoonsgegevens, behalve wanneer bepaalde gegevens op grond van een wettelijke verplichting langer moeten worden bewaard.

12. Rechten van gebruikers
Gebruikers hebben, voor zover van toepassing onder de Algemene Verordening Gegevensbescherming (AVG), het recht om:
- persoonsgegevens in te zien
- onjuiste persoonsgegevens te laten corrigeren
- persoonsgegevens te laten verwijderen
- de verwerking van persoonsgegevens te laten beperken
- bezwaar te maken tegen bepaalde verwerkingen
- persoonsgegevens over te dragen wanneer het recht op dataportabiliteit van toepassing is
- eerder gegeven toestemming in te trekken
Het intrekken van toestemming heeft geen invloed op de rechtmatigheid van verwerkingen die vóór het intrekken van de toestemming hebben plaatsgevonden.

Daarnaast heeft een gebruiker het recht een klacht in te dienen bij de Autoriteit Persoonsgegevens of een andere bevoegde toezichthouder.
13. Gebruikers jonger dan 16 jaar
FreshTrack is niet specifiek ontworpen als app voor kinderen.
Wanneer voor een verwerking toestemming als juridische grondslag wordt gebruikt en een gebruiker jonger is dan 16 jaar, kan toestemming van een ouder of wettelijke vertegenwoordiger vereist zijn.
FreshTrack probeert bewust geen persoonsgegevens van kinderen te verzamelen zonder de vereiste toestemming.
14. Externe diensten
FreshTrack kan voor bepaalde functies gebruikmaken van diensten of software van derden.
Deze partijen kunnen een eigen privacybeleid hebben. Wanneer een externe dienst persoonsgegevens via FreshTrack verwerkt, wordt dit meegenomen in de informatie die wij over gegevensverwerking verstrekken.
FreshTrack controleert periodiek welke externe SDK's en diensten binnen de app worden gebruikt.
15. Internationale doorgifte
Wanneer voor de werking van FreshTrack gebruik wordt gemaakt van een dienstverlener buiten de Europese Economische Ruimte, zorgen wij ervoor dat hiervoor, waar vereist, passende wettelijke waarborgen aanwezig zijn.
16. Wijzigingen in dit privacybeleid
FreshTrack kan dit privacybeleid aanpassen wanneer:
- de functionaliteit van de app verandert
- andere gegevens worden verwerkt
- wet- of regelgeving verandert
- de eisen van appstores of platformleveranciers veranderen
De meest recente versie van het privacybeleid is altijd beschikbaar via de officiële privacybeleidpagina van FreshTrack.
De datum bovenaan dit privacybeleid geeft aan wanneer het beleid voor het laatst is gewijzigd.
